Kenya Integrated Election Management System kits

Disputed Status as of 8 April 2020 · Funding type: Not published

The court record describes IDEMIA's supply of KIEMS kits used in Kenya's 2017 elections 1. Parliament later questioned company registration and recommended investigation, conditional debarment and recovery of payments. IDEMIA challenged those recommendations. The High Court granted limited relief against retrospective application of legislation and Parliament's recovery direction, but rejected the company's procedural unfairness argument 1. This entry records that dispute, not a finding that every aspect of the procurement was lawful. The opened judgment does not establish a later procurement-regulator disposition or current service status.

Timeline

  1. Signed or started: 2017, as recorded in the judgment 1
  2. 23 April 2019: Parliament adopted recommendations for investigation and conditional debarment over company registration, and immediate recovery of payments. IDEMIA contested their legal basis and said it had won the tender on merit. Parliament defended its oversight powers and said the company had been heard 1.
  3. 8 April 2020: The High Court rejected IDEMIA's procedural unfairness claim but quashed recommendations insofar as they retrospectively applied legislation. It held that Parliament lacked power to direct recovery through cancellation of contracts. The judgment did not establish an actual ten-year debarment or give blanket clearance of every procurement issue 1.
  4. 8 April 2020: Recorded status is Disputed.
